5. ערכאה חלופית
לא ייתן השר צו להגבלת סמכות שיפוט, אלא אם כן שוכנע כי קיימת ערכאה שיפוטית או מעין שיפוטית חלופית ראויה, שניתן להגיש בה תביעות לענין נכס התרבות נושא הצו, ושבאפשרותה לדון ולהכריע בהן.
