הוברר לרשם ההוצאה לפועל בהליכים שנפתחו שלא על פי פסקי דין, כי חייב הוא פסול דין כמשמעותו בתקנה 129(ג), ישהה את הליכי ההוצאה לפועל וימנה לו אפוטרופוס לדין.
