בחברה שהציעה לציבור תעודות התחייבות, כמשמעותן בסעיף 35א לחוק ניירות ערך, התשכ״ח–1968, יראו משלוח הצעת מיזוג לנאמן של אותה סדרת תעודות כהמצאת הצעת המיזוג לבעלי תעודות ההתחייבות.
