20. תחולה על המדינה
(א)חוק זה יחול גם על המדינה.
(ב)על אף האמור בסעיף קטן (א), ייצור, שיווק או החזקה של ציוד רפואי הטעון רישום, מתן הוראה על שימוש בציוד כאמור או שימוש בו, בידי צבא הגנה לישראל, ייעשו בהתאם לפקודות הצבא כהגדרתן בחוק השיפוט הצבאי, התשט״ו–1955, ובלבד שבפקודות אלה ייקבעו הוראות שיבטיחו כי ביצוע הפעולות כאמור ייעשה באופן שהתועלת בשימוש בציוד הרפואי למטופלים עולה על הסיכון הכרוך בו.
