על אף האמור בחוק זה, אם היתה סכנה מוחשית ומיידית לבריאות הציבור והתעורר צורך דחוף ומיוחד בניתוח גוויה כדי למנוע סכנה כזאת, מותר לנתחה; שר הבריאות יתקין, באישור ועדת החוקה חוק ומשפט של הכנסת, תקנות לגבי סכנה כאמור.
