היה הרכוש הממשלתי זכות בלתי מסויימת במקרקעין, יהיה הממונה רשאי ליטול חזקה במקרקעין בחלק מסויים מהשטח ששוויו ביחס לשווי כל שטח המקרקעין, הוא כיחס בין הזכות הבלתי מסויימת לכלל הזכויות הבלתי מסויימות מאותו סוג באותן מקרקעין.
