5. פיטורין
תיקון: תשס״ה
לא יפוטר מנהל מחלקת חינוך במעמד קבוע ולא יועבר מתפקידו, לפי המלצת ראש הרשות המקומית ולאחר שניתנה הודעה כדין לכל חברי המועצה על קיום הישיבה שבה יידון דבר הפיטורין או ההעברה מהתפקיד, והתקיים אחד מאלה:
(1)מועצת הרשות אישרה את הפיטורין או את ההעברה מתפקיד ברוב חבריה;
(2)שני שלישים מחברי המועצה שהשתתפו בדיון, אישרו את הפיטורין או את ההעברה מתפקיד.
