הוראות החוק לא יחולו על הגופים במשרד ראש הממשלה כמפורט להלן, ועל המידע שנוצר, שנאסף או שמוחזק בידיהם –
(1)היועץ המדיני לראש הממשלה;
(2)המזכירות הצבאית;
(3)המועצה לבטחון לאומי;
(4)נתיב, למעט מחלקת האשרות;
(5)הממונה על קבילות סייענים;
(6)המכון למחקר ביולוגי.
