36. כוחה של ערובה
הגיש גובה המכס תביעה על ערובּה שניתנה למכס, תהא הצגת כתב הערובּה, בלי ראיות נוספות, מזכה את גובה המכס לקבל נגד בני־האדם שהם לכאורה חותמי כתב הערובּה פסק דין לקיום ההתחייבות שבו, אלא אם כן הוכיחו הנתבעים שקיימו את תנאי הכתב, או שהכתב לא נחתם בידיהם או ששוחררו מן החָבוּת או שיצאו ידי חובתם.
