4. אחריות המקים, המבצע, או המשתמש
(א)פטור מהיתר לפי תקנות אלה לא ישמש הגנה בפני תביעה אזרחית כנגד המקים, המבצע או המשתמש לפי העניין.
(ב)אין בפטור מהיתר לפי תקנות אלה כדי לגרוע מחובה לפי כל דין של בעל זכות במקרקעין או בעל זכות לגביהם, כלפי בעלי זכויות אחרים במקרקעין אלה, או בעלי זכויות אחרים לגבי אותם מקרקעין.
