47. שמירת אחריות פלילית
תיקון: תשפ״ד
(א)תשלום עיצום כספי אין בו כדי לגרוע מסמכותו של תובע להגיש כתב אישום בשל עבירה לפי כל דין.
(ב)הוגש כתב אישום על מעשה שהוטל בשלו עיצום כספי, לא יחויב התאגיד המוסמך בתשלום העיצום הכספי, ואם כבר שולם – יורה המנהל על החזרת הסכום ששולם, בתוספת ריבית שקלית, ויחולו הוראות חוק פסיקת ריבית והצמדה, לעניין ריבית זו, בשינויים המחויבים.
