72. הצהרה בדבר אי־הפרת עיצוב
(א)מי שבכוונתו לבצע פעולה מהפעולות המנויות בסעיף 37(א) או 61, רשאי לבקש מבית המשפט פסק דין הצהרתי שלפיו אין בפעולה המבוקשת משום הפרת עיצוב.
(ב)אין במתן פסק דין הצהרתי כאמור בסעיף קטן (א) או בסירוב לתתו כדי לקבוע בשאלת תוקף העיצוב.
