קב. אי־הופעת התובע
הופיע הנתבע ולא הופיע התובע, והוא הוזמן כדין – ימחוק בית־הדין את התביעה לדרישת הנתבע, אלא אם כן בית־הדין מוצא שלפי הנסיבות אין למחוק את התביעה, ואז יידחה הדיון ללא קביעת תאריך.
