קבלן שמקום עסקו מחוץ לישראל ואין לו מקום עסקים רשום בישראל, רשאי השר לפטור אותו מתחולת חוק זה לגבי ביצוע עבודות הנדסה בנאיות שבגדר מכרז בין־לאומי שהוא מבקש להשתתף בו.
