43. שמירת אחריות פלילית
תיקון: תשפ״ד
(א)תשלום קנס אזרחי לא יגרע מאחריותו הפלילית של אדם בשל עבירה לפי חוק זה.
(ב)הוגש נגד אדם כתב אישום על עבירה לפי פרק זה, לא יחויב בשלה בתשלום קנס אזרחי ואם שילם – יוחזר לו הסכום ששולם בתוספת ריבית שקלית מיום תשלומו ועד יום החזרתו, ויחולו הוראות חוק פסיקת ריבית והצמדה לעניין ריבית זו, בשינויים המחויבים.
