2. הליך שיפוטי ראוי והוגן
הליך שיפוטי ראוי והוגן מתקיים במערכת שיפוטית עצמאית ובלתי תלויה שהוקמה לפי דין, נגישה לציבור, מקיימת דיון לפי כללי הצדק הטבעי, מכריעה בתוך זמן סביר על יסוד הטענות ההדדיות המובאות לפניה, מנהלת את ההליך ופוסקת בו באופן שוויוני, מידתי ויעיל ומנמקת את החלטותיה.
