43. דחיית תביעה במקרים מיוחדים
בית המשפט רשאי לדחות תביעה בכל עת בשל קיומו של מעשה בית דין, התיישנות או מכל נימוק אחר, שלפיו הוא סבור כי ראוי ונכון לדחות את התביעה.
