9. ערר
מי שרואה את עצמו נפגע על ידי צו לשימוש ארעי רשאי, תוך שלושים ימים מיום קבלתו, לערור עליו לפני בית המשפט לעניינים מקומיים, ובאיזור בו אין בית משפט כזה מכהן, לפני בית משפט השלום, ובית המשפט רשאי לבטל את הצו או לאשר את הצו, בשינויים או בלי שינויים, הכל כפי שיקבע, ורשאי הוא לחייב את הרשות בהוצאות שגרמה לבעל המגרש, לרבות שיפוי על נזקים שהיו לו.
