על אף האמור בתקנה 1 רשאי מפקח העבודה הראשי להתיר העסקת נער בעבודה פלונית, במקומות, בתנאים ובהגבלות שקבע בהיתר, אם היא חיונית, לדעתו, להכשרה מקצועית של הנער.
