4. סייג לתחולה
האמור בתקנות 2 ו־3 לא יחול על סיגריה אלקטרונית, מחסנית או חומר מילוי שהם תכשיר הרשום בפנקס או תכשיר המשווק לפי היתר שנתן המנהל לפי הכללים שנקבעו לפי סעיף 47א(ג) לפקודה.
