2. הזכות לתבוע פיצויים
זכאי לתבוע פיצויים בעד נכס (להלן – תובע) הוא מי שהיה תושב ישראל ביום תחילתו של חוק זה, או שהיה לתושב ישראל לאחר תחילתו, ולפני שהנכס הוקנה לאפוטרופוס היה אחד מאלה:
(1)בעל הנכס, לרבות מי שהיה יורשו אילולא הוקנה הנכס;
(2)נפקד כשהוא דייר בלבד בנכס עירוני, לרבות אשתו שגרה עמו אותה שעה;
(3)חוכר הנכס;
(4)בעל זיקת הנאה בנכס.
