8. פגם בתובענה
לא תיפסל תובענה עקב כל פגם בה, אם לדעת בית הדין, אין בדבר חשש לעיוות דינו של הנאשם; אולם רשאי בית הדין לדחות את הדיון למועד אחר וליתן הוראות כפי שימצא לנכון כדי להסיר את החשש.
