85. שינוי בהרכב בית הדין
תיקון: תשכ״ח, תשס״ג
(א)נבצר מאחד מחברי בית הדין להמשיך בדיון או לסיים אותו, יקבע אב בית הדין חבר אחר במקומו; בית הדין בהרכבו החדש רשאי להמשיך בדיון מהשלב שאליו הגיע לפני שינוי ההרכב.
(ב)על אף האמור בתקנת משנה (א) מותר לקרוא פסק דין או גזר דין שנחתמו בידי כל חברי בית הדין, אף אם נבצר מאחד או משנים מחברי בית הדין להיות נוכחים בשעת השימוע.
