4. סייגים למינוי
תיקון: תשמ״ז, תשס״א
הוצע אדם כמועמד לתפקיד, והכונס הרשמי סבור – מתוך נסיון קודם עם המועמד או מטעם אחר – שאין הוא מתאים להתמנות לתפקיד האמור, יודיע על כך לבית המשפט ויפרט בהודעתו את נימוקיו לכך; בית המשפט יחליט בדבר המינוי לאחר שיתן למציע ולמועמד הזדמנות להשמיע את טענותיהם.
