9. נוכחות בעלי הדין
הדיון בערעור או בבקשה יהיה בנוכחות בעלי הדין; אולם אם הוזמן בעל דין ולא התייצב, רשאי השופט לדון בערעור שלא בפניו; לא התייצב המערער, רשאי השופט למחוק את הערעור.
