האמור בתקנה 1(2) אינו בא לשחרר פעולות חציבה או כרייה שיש עליהן רשיון לפי פקודת המכרות מקבלת היתר אם עבודת החציבה או הכרייה אינה מותרת במקום ביצועה על פי כל תכנית.
