בלי לגרוע מהאמור בתקנות 2 ו־3, מסר אלקטרוני מאושר לפי סעיף 44יא5 לחוק שעניינו נתוני המשתמשים במערכת ההצבעה האלקטרונית – דינו כדין אישור בעלות לגבי כל מחזיק בכתבי אופציה הנכלל בו.
