Section 5 of תקנות מס הכנסה (פחת מואץ בתקופת ההתמודדות עם נגיף הקורונה) (הוראת שעה), התשפ״א–2020, סייגים לתחולה.
5. סייגים לתחולה
(א)תקנות אלה לא יחולו על ציוד שרכש הנישום באחת מאלה:
(1)רכישה מקרוב;
(2)רכישה בלא תמורה;
(3)רכישה לפי סעיף 85 לפקודה;
(4)רכישה שחלו עליה הוראות חלק ה2 לפקודה.
(ב)תקנות אלה לא יחולו על נישום שקיבל זכות נפט כהגדרתו בחוק מיסוי רווחים ממשאבי טבע, התשע״א–2011, זיכיון או זיכיון משנה מהמדינה, לגבי ציוד המשמש לצורך הפעילות שבעדה קיבל את זכות הנפט, הזיכיון או זיכיון המשנה כאמור.
