9. סייג לתחולה
תקנות אלה יחולו על מכרזים שעורך משרד הבטחון, למעט מכרזים –
(1)שעורכת יחידת סמך כמשמעותה בתקנות מערכת הבטחון;
(2)שעורכת יחידה במשרד הבטחון המתנהלת כמשק סגור ושבניהולה ובהפעלתה מעורבים שיקולים עסקיים;
(3)לגבי עבודות הנדסה בנאיות כהגדרתן בחוק רישום קבלנים לעבודות הנדסה בנאיות, התשכ״ט–1969.
