16. התובע והנתבע
מי שאינו המחזיק במקרקעין יהיה התובע, והמחזיק יהיה הנתבע; לא היה אדם מחזיק במקרקעין, או היה ספק מי הוא המחזיק בהם, יחליט בית־המשפט מי מבין בעלי התביעות יהיה תובע ומי הנתבע.
