לא נתמנה יועץ משפטי חדש לפני תום תקופת הכהונה של מי שקדם לו בתפקיד, רשאית הממשלה, לאחר התייעצות בועדה, להאריך לתקופה שאינה עולה על שישה חודשים, את משך הכהונה של היועץ המשפטי המכהן אותה שעה או למנות לו ממלא מקום לתקופה שאינה עולה על שלושה חודשים, לפי הוראות סעיף 23 לחוק שירות המדינה (מינויים), התשי״ט–1959.
