2. פטור ממס רכישה למוסד ציבורי
על אף האמור בתקנות שיעור מס רכישה, מוסד ציבורי יהיה פטור ממס רכישה, ברכישת זכות במקרקעין ממוסד ציבורי אחר או מרשות מקומית, אם שוכנע המנהל כי המקרקעין משמשים את המוסד הציבורי במישרין או ישמשו אותו כאמור בעתיד.
