164. הדיון מוגבל לנימוקים שבכתב
בשמיעת הערר לא תיזקק הועדה לכל נימוק שלא הוזכר בהודעת הערר או בתשובת המשיב, אלא אם היא משוכנעת שההשמטה נגרמה שלא באשמת בעל הדין המבקש להיעזר באותו נימוק, או ששמיעת הנימוק הנוסף דרושה לשם עשיית צדק.
