2. הסמכת בודק
(א)החליטה הרשות, לצורך מילוי תפקידיה, על ביצוע בדיקה, בין לגבי חברה מסוימת ובין לגבי סוג של חברות, ובין בענין מסוים ובין בסוג של ענינים, באמצעות מי שהסמיכה לכך (להלן – בודק), רשאי הבודק לעיין ברשומות ובמסמכים של החברה ולדרוש – מהחברה או ממי מהמנויים בסעיף 55 לחוק – מידע וחומר בעניני החברה.
(ב)זכותו של הבודק לקבלת מידע תהיה כשל הרשות, אלא אם כן קבעה הרשות אחרת.
