17. סמכויות הדן בערר
נוסף על האמור בסעיף 41 לחוק, רשאי הדן בערר –
(1)להתיר הבאת ראיות אם היה סבור כי הדבר דרוש לעשיית צדק;
(2)להסיק מחומר הראיות, בין שהיה לפני הערכאה הקודמת ובין לפניו, מסקנות שונות משהסיקה הערכאה הקודמת או לקבוע כי אין בו יסוד למסקנותיה.
