חייל שקיים ברשלנות פקודה או הוראה שניתנה לו, או שהתרשל במילוי תפקידו בצבא, דינו – מאסר שנה; מפקד יחידה או חייל בדרגת סמל ומעלה שעבר עבירה כאמור, דינו – מאסר שנתיים.
