על החלטת בית דין של ערכאה ראשונה לפי סעיף 310 רשאי בעל דין לערער לפני בית הדין הצבאי לערעורים תוך שלושה ימים מיום נתינתה, ועליו להודיע לבית הדין על רצונו לערער מיד עם נתינתה.
