נפטר אחד הנהנים מן הצוואה לפני מותו של המצווה, והמצווה לא תיקן את צוואתו לפני מותו – חלקו של הנהנה הנפטר יינתן ליורשיו לפי המצוות החוקתיות אם יש לו יורשים, ואם אין לו יורשים יינתן חלקו ליורשי המצווה שהם בחיים.
