לא היו נשים אסורות בנישואין או היו אך לא נמצאו כשירות להשגחה, עוברת הזכות אל העצבה לפי סדר הירושה. עדיפות תינתן לאב, אח״כ לסב, אח״כ לאח מאותו אב ואותה אם, אח״כ לאח מצד האב, אח״כ לבני האח מאותו אב ומאותה אם, אח״כ לבני האח מצד האב, אח״כ לדוד (אחי האב) מאותו אב ומאותה אם, אח״כ לדוד (אחי האב) מצד האב. היו מספר הזכאים להשגחה בדרגה אחת תינתן עדיפות לראוי יותר שביניהם, ואח״כ למבוגר שביניהם.
