האם חייבת, לפני יתר הקרובים, בהוצאות ילדה במקרה שאביו היה מחוסר אמצעים. היו שני ההורים מחוסרי אמצעים ויש להם ילדים הזכאים למזונות, יחויב בהם הקרוב, הקרוב ביותר שהוא בעל האמצעים. הוצאות הקרוב יהיו חוב על האב מחוסר האמצעים, ויוכל לתבעו ממנו אם נהיה בעל אמצעים, בין שהקרוב היה אם או סב או אחר.
