היה אביו של הילד העני מחוסר אמצעים, וקרוביו של הילד היו בחלקם הורים והורי הורים ובחלקם חואשי, הרי אם היה אחד משני הסוגים יורש והשני איננו יורש – יחויב הסוג הראשון במזונות בין שהיה הוא היורש ובין שלא. היו שני הסוגים יורשים אזי מתחשבים בירושה ויחויבו במזונות כשיעור חלקם בירושה.
