ביקש המערער כי הדיון יתנהל בפניו, יתנהל הדיון בפני המערער והמשיב, אולם אם הוזמן בעל דין ולא התייצב ללא הצדק סביר, רשאי בית הדין לדון בערעורו שלא בפניו.
