משהובא הנאשם בפני בית־משפט צבאי לשפיטה, תירשם מהות ההאשמה שעל הנאשם בכתב, ותורצה לפניו בלשון שהוא מבין והוא יישאל אם הוא מודה באמיתותה או מכחיש אותה.
