החליט הפרקליט הצבאי הראשי שיש למנות שופט חוקר לענין מסויים, יעביר את החלטתו בכתב לידי נשיא בית הדין הצבאי לערעורים כדי שימנה אחד השופטים הצבאיים המשפטאיים להיות שופט חוקר באותו ענין.
