40. שמיעת בעל האמצאה והפטנט
דרשו ממציא או שאיריו את ציון שם הממציא – שעה שאין הבעלות באמצאה או בפטנט בידם – יתן הרשם הודעה על כך לבעל האמצאה או לבעל הפטנט, ואם היו אותה שעה תלויים ועומדים הליכי התנגדות לפי סעיף 30 – לכל אדם אחר שהוא צד לאותם ההליכים; הרשם יחליט לאחר ששמע את טענותיהם של הנוגעים בדבר, אם ביקשו זאת תוך המועד שנקבע.
