9. זכאות מכוח מגורים
מי שביום ב׳ בטבת תשל״ט (1 בינואר 1979) וביום תחילתו של חוק זה נתקיימו בו שלושה אלה:
(1)התגורר באורח קבוע ושלא מכוח הסדר עם מינהל מקרקעי ישראל במבנה שבקרקע שקמה לקנין המדינה לפי חוק זה;
(2)לא היה לו מקום מגורים קבוע במקום אחר;
(3)לא החזיק בכלל בקרקע שקמה לקנין המדינה לפי חוק זה – (להלן – זכאי מכוח מגורים),
זכאי אף הוא לפיצויים ולהטבות כמפורט בתוספת השניה או השלישית.
