4. סייג
המנהל רשאי לפטור בעל עסק מחובת התקנת מז״ח אם שוכנע כי לא קיימת סכנה למי השתיה מזרימה חוזרת של המים מהעסק, או כי נעשה בעסק שימוש במכשיר הגנה אחר המתאים בנסיבות הענין.
השר הסמיך את מהנדסי התברואה המחוזיים במשרד הבריאות להיות ”המנהל“ לעניין תקנה זאת (י״פ תשנ״ג, 560).
