5. דחיית בקשה לקבלת מידע
(א)החלטת ראש הרשות המוסמכת לדחות את בקשת המידע, כולה או חלקה, תהיה בכתב ומנומקת, ולאחר שניתנה למבקש הזדמנות לטעון את טענותיו לפניו; ראש הרשות המוסמכת ייתן את החלטתו בהקדם האפשרי בנסיבות העניין, ומתוך התחשבות במידת הדחיפות שצוינה בבקשה.
(ב)החלטת ראש הרשות המוסמכת לדחות את הבקשה תועבר למבקש מיד לאחר קבלתה.
