4. התנאים למסירת הודעה על הכרה במעשה
המדינה תמסור הודעה לבית המשפט, לגבי עובד ציבור שהוא עובד מדינה, כי היא מכירה בכך שמעשה העובד נעשה תוך כדי מילוי תפקידו השלטוני, כאמור בסעיף 7ב(א) לפקודה (להלן – הודעת הכרה), אם התקיימו כל אלה:
(1)המעשה נעשה תוך כדי תפקידו השלטוני של העובד;
(2)המעשה לא נעשה ביודעין מתוך כוונה לגרום נזק או בשוויון נפש לאפשרות גרימתו במעשה כאמור.
