4. תנאי מקדמי להפחתה בהפרות מסוימות
היתה ההפרה שבשלה הוטל העיצום הפרה של אי־דיווח לפי הוראת סעיף 11(ב)(2) לחוק או אי־העברת תשלומים לקרן לפי הוראת סעיף 11(א) לחוק, לא יורה הממונה על הפחתת סכום העיצום הכספי בהתאם להוראות תקנה 2 או 3, אלא לאחר שהמפר העביר לו דיווח, או העביר תשלומים לקרן, לפי העניין.
